2. Scope
These Terms and Conditions (T&C) govern access to and use of the auriscollection.com website, as well as the purchase of products through the Auris online store. Placing an order implies full and unreserved acceptance of these T&C. Swiss law shall apply to the contractual relationship established.
3. Age verification
Access to the website and the purchase of products is restricted to persons over the age of 16 (minimum legal age for purchasing wine and beer in Switzerland under the Federal Alcohol Act – LAlc). The purchase of spirits is reserved for people over 18. By accessing the website, the user declares to comply with the applicable age requirements.
4. Registration and User Account
Users can make purchases with or without registration. If you register, you are responsible for the confidentiality of your access credentials and for all activities carried out with your account. Auris reserves the right to suspend or cancel accounts in the event of misuse.
5. Products and Availability
All products featured on the website are subject to stock availability. The vintage years and prices indicated are given without commitment of duration and may be changed without prior notice. Auris reserves the right to refuse or cancel orders for products that are out of stock.
6. Pricing
All prices are quoted in Swiss Francs (CHF) and include applicable Swiss taxes, unless otherwise stated. For exports, the exchange rate on the day of sale will apply. Auris reserves the right to change prices at any time.
7. Ordering
An order is considered firm after written confirmation from Auris (confirmation e-mail). Any modification or cancellation must be requested before the goods are dispatched and confirmed in writing. Auris may, at its discretion, refuse orders without justification.
8. Data Protection
Personal data is processed in accordance with the Auris Privacy Policy, available at auriscollection.com/privacy-policy, and in accordance with the nLPD.
9. Intellectual property
All website content (texts, images, logos, videos) is the exclusive property of Auris or its licensors. Any reproduction, in whole or in part, is prohibited without prior written authorization.
10. Limitation of Liability
Auris cannot be held liable for indirect damages, loss of profits or loss of data resulting from the use of the website. Auris’ liability is limited to the value of the order in question.
11. Dispute resolution
In the event of a dispute arising from the interpretation, execution or resolution of these Terms and Conditions, the parties undertake to first seek an amicable solution through direct negotiation.
If it is not possible to reach an amicable settlement, the parties may, as good commercial practice and before resorting to the courts, submit the dispute to arbitration, namely with the Swiss Arbitration Centre (www.swissarbitration.org), an international reference institution based in Switzerland, or with the Arbitration Court of the Canton of Geneva, under the terms of the respective regulations in force. The choice of arbitration mechanism will depend on the value and nature of the dispute, and the parties must agree in writing to its use.
In the absence of an agreement on arbitration, or if the parties so prefer, disputes shall be submitted to the exclusive jurisdiction of the Ordinary Courts of Geneva, with the application of Swiss law.
For consumer disputes, users can also turn to the Swiss Consumer Mediation Center (www.konsum.ch) or the alternative dispute resolution mechanism available at www.moderatore.ch.
12. Amendments to the T&C
Auris reserves the right to modify these T&C at any time. The version in force at the time the order is placed is the applicable one. Continued use of the website after the publication of changes implies acceptance of them.
